“Confidential Information” means information, whether disclosed orally, electronically or in writing, that is designated as confidential or that is information that a reasonable person would be expected to know, based on its nature or the circumstances of its disclosure, is confidential.
Confidential Information shall not include information that (i) is or becomes publicly known through no fault of recipient, (ii) was in a party’s possession prior to disclosure by the other party without breach of any legal obligation owed to disclosing party, or (iii) is received from a third party without such party’s breach of any legal obligation owed to disclosing party.
Each party agrees that, in the event a party is exposed to the other party’s Confidential Information, the recipient: (i) will protect Confidential Information from unauthorized disclosure with commercially reasonable care, (ii) will not disclose Confidential Information to any third party (provided that Evention may disclose Client’s Confidential Information to any of its Affiliates or to any vendor as necessary for the provision of services), and (iii) will not use Confidential Information other than as authorized by this Agreement.
2. Intellectual Property Rights
Client acknowledges that EVENTION or its licensors possess all intellectual property right including but not limited to: copyright, trademark, patent, modifications to the Services, related documentation and marketing materials regardless of (i) whether such intellectual property ownership notice appears on the materials or (ii) whether such intellectual property ownership have been filed with governmental agencies. Nothing in this Agreement will directly or indirectly be construed to assign or grant the Client any right of ownership, title or interest in the Services, or any intellectual property rights relating thereto.
Client agrees not to disclose to anyone any proprietary or confidential information of EVENTION which Client may receive through the Services or access to the Site. The Client will not use any confidential information to compete against EVENTION or reverse engineer our product offerings. Any access by third parties is unauthorized without explicit consent by EVENTION. Client agrees not to copy, record, publish, compile, reproduce, republish or resell for any commercial purpose of any information in our Site or through the Services. In addition, Client agrees to pay all reasonable attorney’s fees and costs incurred in enforcing these provisions.
3. Data Privacy and Security
EVENTION implemented firewall protection services to protect customers’ data from unauthorized access. All data has been encrypted with AES 256.
IP restriction can be implemented where only authorised IP addresses can access the website.
Cookies, clear GIFs, etc. The Platform may use cookies (small pieces of information that are stored by your browser on your computer’s hard drive), clear GIFs, javascript and other technology to collect and store information about your use of the Platform, such as your search activity, the pages you view, and the date and time of your visit, your browser type, type of computer or mobile device, browser language, IP address, mobile carrier, unique device identifier, location information, and requested and referring URLs. We may combine this information with other information that we have collected about you, including, where applicable, your username, name, and other personal information.
Customer data is hosted in either AWS or Microsoft Azure with the best security practices and standard in the industry.
4. Streaming in China
For video streaming serving audiences in Mainland China, the Chinese Government may determine the streaming due to the possible restricted contents without warning.
For Video on demand, all contents will subject to request to go through screening process by the hosting platform under the law of Chinese Government.
